These Terms of Service ("Terms") govern your access to and use of the AppYourDocs website, API, and software-as-a-service platform (collectively, the "Service"). By creating an account, accessing, or using the Service, you ("User", "you", or "your") agree to be bound by these Terms.

1. Description of Service

AppYourDocs provides a platform for automated document parsing, optical character recognition (OCR), and data extraction. The Service allows users to upload unstructured files (e.g., PDFs, images) and returns structured data formats (e.g., JSON, Excel).

2. User Accounts and Security

To access certain features, you must register for an account. You are solely responsible for maintaining the confidentiality of your account credentials (including API keys) and for all activities that occur under your account. AppYourDocs shall not be liable for any loss or damage arising from your failure to adequately secure your credentials.

3. User Content and Uploads

a. Ownership: You retain all intellectual property rights to the documents, text, images, and data you upload to the Service ("User Content").

b. License to Process: By uploading User Content, you grant AppYourDocs a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, and process the User Content strictly for the purpose of providing the Service to you.

c. Prohibited Content: You explicitly agree NOT to upload:

• Documents containing highly sensitive personal data without proper authorization (e.g., unredacted protected health information (PHI) unless a specific BAA is signed, government-issued IDs not relevant to your business workflow).
• Content that is illegal, defamatory, fraudulent, or violates the intellectual property rights of any third party.
• Files containing malware, viruses, or destructive code.

d. Liability for Uploads: AppYourDocs acts merely as a passive conduit for processing your data. We do not independently verify, endorse, or claim ownership of your User Content. You bear full legal responsibility for ensuring you have the right to process the data you upload through our Service.

4. Data Loss, Backups, and Accuracy

a. No Guarantee of Accuracy: While AppYourDocs utilizes advanced AI models to achieve high accuracy, OCR and AI extraction are not flawless. We provide confidence scoring as a guide, but you acknowledge that extracted data may contain errors. AppYourDocs is not responsible for any financial, legal, or operational damages resulting from inaccurate data extraction. It is your responsibility to verify the output.

b. Data Retention & Loss: AppYourDocs is a processing pipeline, not a system of record. While we offer limited storage history for paid tiers, we do not guarantee the permanent preservation of your data. You are strictly responsible for maintaining independent backups of all original documents and extracted data. AppYourDocs shall not be held liable for any accidental loss, deletion, or corruption of User Content or extracted data, regardless of the cause (including system failures or cyberattacks).

5. API Usage and Rate Limiting

Users accessing the Service via API are subject to rate limits and volume restrictions based on their subscription tier. AppYourDocs reserves the right to throttle, suspend, or terminate API access immediately if a user's activity places an unreasonable load on our infrastructure, constitutes abuse, or attempts to reverse-engineer our engine.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APPYOURDOCS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE. UNDER NO CIRCUMSTANCES WILL APPYOURDOCS BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT. IN NO EVENT SHALL APPYOURDOCS' TOTAL CUMULATIVE LIABILITY EXCEED THE AMOUNT YOU PAID TO APPYOURDOCS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7. Indemnification

You agree to defend, indemnify, and hold harmless AppYourDocs and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.

8. Termination

AppYourDocs reserves the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease, and all data may be permanently deleted from our servers.

9. Modifications to the Service and Terms

AppYourDocs reserves the right to modify or discontinue the Service (or any part thereof) temporarily or permanently without notice. We may update these Terms from time to time. Continued use of the Service following any updates constitutes your acceptance of the revised Terms.
